| Since the early 1980's, environmental insurance has been a viable solution to a company's potential environmental liability. With the promulgation of laws such as the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and the Resource Conservation and Recovery Act (RCRA), many manufacturers and other companies with inherent environmental risks suddenly found themselves in a position of potential catastrophic impacts to their bottom line.
As claims began to overwhelm the standard insurance marketplace, the marketplace fought back and drafted the Absolute Pollution Exclusion. Hence, the environmental insurance market was born. Today, it is a mature multi-billion dollar industry that has grown in sophistication and has adapted to the constant changes faced by the industries.
